The first in Ukraine release of a vessel against the British P&I Club’s undertaking
Result
The precedent in the Ukrainian law enforcement practice was established in the interests of CHALLENGE SHIPPING LTD, the owner of the bulk carrier New Challenge, detained at the Port of Mykolaiv in connection with an incident taking place during cargo operations. The team of Odesa Office of Ilyashev & Partners has secured the acceptance by the State Ecological Inspection of Ukraine of the P&I club’s letter of undertaking as a sufficient and only security in respect of the maritime claim.
Lifting the unlawful financial burden imposed on green energy companies
Result
As a result of a two-year legal dispute were recognized as unlawful and invalid the amendments to the formula approved by the National Commission for State Regulation in the Spheres of Energy and Utilities, which obliged electricity producers under the “green” tariff to compensate SE Guaranteed Buyer for losses incurred due to its inability to sell the electricity purchased from them.
Introduction of provisional anti-dumping duty on imports of glass containers from Belarus
Result
A provisional anti-dumping duty of 31.37% was applied to glass containers for food and beverages originating in the Republic of Belarus based on the interim results of the anti-dumping investigation. This decision on application of provisional duty on imports of goods to Ukraine was the first decision adopted by the Interdepartmental Commission on International Trade after 24 February 2022.
Defending the Red Cross emblem in a dispute with a network of medical centers
Result
The network’s obligation to stop using the Red Cross emblem was formalized in an amicable agreement approved by the Commercial Court within a framework of a court action. The network started the rebranding. The dispute became the first case in 30 years of successful protection of the Red Cross emblem in Ukraine.
