Protecting trademark rights of Latvian pharmaceutical company “Kalceks” in Ukraine for “Promedol”
Result"Promedol" was ruled by the Supreme Court to be an international non-proprietary name (INN) of a medicinal product and therefore cannot form the basis for a trademark, as it would cause monopolization and unfair competition in the market. An official publication of the invalidation of the Ukrainian manufacturer's certificates for the "Promedol-ZN" and "Promedol" trademarks was ordered by the Court.
Legal support for ESTDEV international technical assistance projects in Ukraine
ResultWithin the donor-funded infrastructure projects of the Estonian Centre for International Development (ESTDEV), a regulatory and tax framework for their implementation was developed and the projects were registered as International Technical Assistance projects. Application of the ITA regime made it possible to preserve tax incentives, including VAT exemption, and to ensure uninterrupted funding and project execution with a foreign donor.
First-ever application of definitive anti-dumping duties in Ukraine for circumvention of trade restrictions
ResultThe Interdepartmental Commission on International Trade has, for the first time in Ukraine, imposed definitive anti-dumping duties on imports of goods from Malaysia due to the circumvention of duties previously introduced on products originating from the PRC. The duty rates were set at up to 67.40%. The decision established the precedent for counteracting the circumvention of trade restrictions through a change of the country of origin of goods.
