Dispute resolution is one of the key areas at Ilyashev & Partners. We never stop at just obtaining a judgment; we also ensure its enforcement. We have extensive experience in protecting clients’ rights within the international court institutions and helping our clients in their interactions with foreign courts and law enforcement authorities.

Ilyashev & Partners Law Firm has the strongest dispute resolution practice in Ukraine and nearly 30 years’ experience representing clients in litigation, including disputes involving foreign elements. The team participates in more than 1,000 court hearings each year and handles over 500 court cases, making it one of the most active litigation teams in Ukraine.

We represent international corporations, investors, banks, state-owned enterprises and major Ukrainian companies in courts of all instances, including the Supreme Court, as well as in disputes spanning multiple jurisdictions. The total amount of claims in disputes handled by the firm’s lawyers exceeds $100 billion.

Result
"Promedol" was ruled by the Supreme Court to be an international non-proprietary name (INN) of a medicinal product and therefore cannot form the basis for a trademark, as it would cause monopolization and unfair competition in the market. An official publication of the invalidation of the Ukrainian manufacturer's certificates for the "Promedol-ZN" and "Promedol" trademarks was ordered by the Court.

Legal support for ESTDEV international technical assistance projects in Ukraine

Within the donor-funded infrastructure projects of the Estonian Centre for International Development (ESTDEV), a regulatory and tax framework for their implementation was developed and the projects were registered as International Technical Assistance projects. Application of the ITA regime made it possible to preserve tax incentives, including VAT exemption, and to ensure uninterrupted funding and project execution with a foreign donor.

Result
The Interdepartmental Commission on International Trade has, for the first time in Ukraine, imposed definitive anti-dumping duties on imports of goods from Malaysia due to the circumvention of duties previously introduced on products originating from the PRC. The duty rates were set at up to 67.40%. The decision established the precedent for counteracting the circumvention of trade restrictions through a change of the country of origin of goods.
