Yana Trynova, Attorney at Law at Ilyashev & Partners Law Firm, Dr. iur., Professor, spoke at the “Business VS Psychology” Forum, which took place on October 17, 2025, in Kyiv. The event was organized by the psychological center Power Mental Health.
In her presentation titled “Recent Trends in Legislation. Discussion of Law No. 4223-IX ‘On the Mental Health Care System in Ukraine.’ Confidentiality Issues in the Work of a Corporate Psychologist,” Yana Trynova discussed the new regulatory framework governing activities in the field of mental health and the significance of the new law for employers.
She highlighted key innovations, including the certification of psychologists and psychotherapists, the creation of registries of service providers and supervisory bodies, as well as the mandatory protection of clients’ personal data. Yana emphasized that the law does not require companies to employ in-house psychologists, but allows them to cooperate with mental health professionals either under civil or employment contracts.
“The new certification rules and service standards in the field of mental health enhance professional competence, but do not make it mandatory for all employers to provide such services. Companies may decide for themselves how to support their employees’ mental well-being. At the same time, a psychologist’s file on a specific client constitutes that client’s personal data. Therefore, it is critically important to ensure the protection of such data in accordance with the law, to define who acts as the data controller and data processor, and to maintain confidentiality in all contractual or employment relations with specialists,” noted Yana Trynova.
The forum also addressed the issues of maintaining confidentiality in corporate psychologists’ work, the procedures for processing personal data, as well as the prospects for developing the mental health sector in Ukraine and its interaction with the business community.
Participants included representatives of businesses, psychological and professional associations, insurance companies, and corporate psychologists.
