Mykola Skvortsov, Attorney at Law of Ilyashev & Partners Odesa Office, delivered a report about “Application of the “club guarantee” for securing the claims of the State Ecological Inspection: 2020 practice and prospects of legislative regulation” at the webinar hosted by the Committee of Ukrainian Advocates’ Association on Maritime Law, which took place on 20 April 2021.
Mykola highlighted the incident with New Challenge Bulk Carrier in the Port of Mykolaiv as a success story, of which Odessa Office team had become part by persuading the State Ecological Inspection of Ukraine to accept the P&I Club`s letter of undertaking as a sufficient and only security in respect of the maritime claim.
Mykola Skvortsov also dwelled on the key provisions of the new procedure for calculating the amount of compensation and payment of losses caused as a result of pollution from vessels and stressed the necessary to regulate legal status of undertakings issued by P&I Clubs on legislative level in Ukraine. Participants of the webinar discussed particulars of disputing actions of the State Ecological Inspection of Ukraine as a matter of administrative litigation, prospects of ecological control of vessels at maritime ports and relevant court practice. Among the speakers there were advocates from leading law firms of Ukraine specializing in the field of maritime law.
