Mikhail Ilyashev, Managing Partner of Ilyashev & Partners Law Firm, delivered a speech at the XII Annual Analytical Forum “Pharmavision-2018”, held on February 15-16, 2018 in Kyiv.
In his report entitled “Protection Against the Unfair Competition in the Pharmaceutical Market”, which was delivered during the second day of the forum, Mikhail Ilyashev highlighted the most common manifestations of the unfair competition and ways to protect the rights of the pharmaceutical manufacturers at the Antimonopoly Committee of Ukraine (AMCU) and in courts, and gave practical advice on how to prepare responses to the AMCU’s inquiries.
“Year after year our firm witnesses growth in the number of cases related to the unfair competition in the pharmaceutical market, – noted Mikhail Ilyashev. – Unfortunately, all disputed situations have to be resolved post factum: despite the fact that lawyers are often involved in the preparation of contracts, they are hardly ever consulted to get advice on issues of medicinal product promotion and advertising. As a result, the violations of intellectual property rights and unfair advertising became a pervasive phenomenon in the pharmaceutical market”.
During his speech Mikhail presented real cases from Ilyashev & Partners’ practice, and described the AMCU’s current practice in cases on protection against the unfair competition and judicial practice in cases on protection of intellectual property rights of the pharmaceutical manufacturers.
