Mikhail Ilyashev, the Managing Partner of Ilyashev & Partners Law Firm, and Roman Marchenko, the Senior Partner, delivered speeches at the All-Ukrainian Forum “Ukraine 30. Progress of Justice”, which took place on March 1-3, 2021 in Kyiv.
Within the framework of the panel Basic Principles of Legal Defense Development Mikhail Ilyashev emphasized the need for the State to ensure that the legal profession guarantees are duly observed.
“Ukrainian legislation prohibits the identification of the attorney with the client, not only for the State represented by the officials of the state authorities and, in particular, the law enforcement agencies, but also for the media, banks, companies and even individuals. Yet, however, any prohibition is effective only if there are sanctions for its violation. It is mandatory to create provisions that would establish liability for violation of the prohibition and identification of the attorney with the client. The inadmissibility of such identification should be established at the level of all state bodies and authorities”, – emphasized Mikhail Ilyashev.
Roman Marchenko moderated the session Case Studies: Legal Success Stories of Ukraine at Global Scene, discussing the major international disputes with the participation of Naftogaz of Ukraine, Oschadbank, the Ministry of Justice of Ukraine, and the Ukrainian Football Association.
The All-Ukrainian Forum “Ukraine 30. Progress of Justice” brought together the representatives of the diplomatic corps from G7 countries, international experts, top officials and representatives of the Ukrainian authorities – the Presidential Office of Ukraine, the Government, Members of the Parliament. The forum participants discussed the role and mission of the Constitutional and Supreme Courts, as well as the draft of the new Criminal Code and the prospects for recodification of the Civil Code of Ukraine.
