Leonid Gilevich, the Counsel at Ilyashev & Partners Law Firm, participated in the Forum “Business Integrity. National Agenda”, held within the framework of Business Integrity Week ’19 organized by the Ukrainian Network of Integrity and Compliance (UNIC) together with the United Nations Development Programme (UNDP).
Leonid Gilevich presented Recommendations on the elimination of corruption risks in the field of shadow economy combating with regard to regulation of control over official employment and payment of legal wages. The Recommendations were prepared by UNIC together with the Compliance Practice team of Ilyashev & Partners within the framework of the UNDP project “Strengthening the Principles of Integrity in the Interaction between the State and Business”, aimed to establish effective cooperation between state authorities and business representatives.
As part of the project, the working group, with the participation of Valeriia Gudiy and Leonid Gilevich, analyzed the legal acts, internal documents of the public authorities, interviewed representatives of business and public authorities, consulted with the Business Ombudsman Council and the UNIC Secretariat.
“These recommendations were prepared as the result of hard work, consisting of not only the analysis of certain provisions and practices, but also of discussion of relevant issues with the state authorities directly involved, first of all, with the State Labor Service of Ukraine”, – said Leonid Gilevich. – Given the fact that on May 14 the Sixth Administrative Court of Appeal recognized as invalid the Resolution of the Cabinet of Ministers of Ukraine No. 295 dated 29 April 2017, which regulates the issues of state control and supervision over compliance with labor legislation, there is now a unique opportunity to adopt a new decent regulatory act, which would promote the effective business activities. And the recommendations we elaborated can help with the development of such a document”.
The working group has prepared a series of recommendations to the Government of Ukraine on improving the implementation of the state policy in the field of labor relations regulation and prevention of corruption in such public authorities as the State Fiscal Service of Ukraine, the State Labor Service of Ukraine, the National Police of Ukraine, etc.
