Leonid Gilevich, a lawyer of Ilyashev & Partners’ Employment Practice, delivered a speech on “Disputed Dismissals of the Top Managers: Proper Termination of Labor Relations” at a business breakfast for HR directors of leading Ukrainian companies within the framework of HR-Brand Ukraine 2017 Award, organized by the HeadHunter Ukraine on February 14, 2018 in Kyiv.
Leonid Gilevich described in detail the advantages and risks of the most common reasons for termination of employment with top managers in Ukraine, such as the agreement of the parties, termination of the employment contract, dismissal on grounds provided for in the employment contract, reduction in the number of employees, dismissal during probation and termination of official powers.
Leonid gave a number of practical recommendations from his own experience for the most effective termination of labor relations in conflict situations.
“In most cases the most preferable option for termination of labor relations is the dismissal by agreement of the parties, which can take place even in those situations where the employer and the employee initially did not intend to agree. In this situation the employer, as a rule, gets an opportunity to cease cooperation in a civilized way, namely, to agree the date and conditions for termination with the due hand-over by the dismissed employee of the responsibilities, documents and information; that said, the risk of contestation of such dismissal by the employee in court will be very low, – he noted. – The employee, in turn, may expect for some additional compensation, as well as, in certain cases, recommendations for further employment. Consequently, where the employee is ready to negotiate, his/her requirements are acceptable, and he/she did not commit any unlawful acts during the term of employment, – we always recommend our clients to terminate the employment by agreement of the parties”.
