Ilyashev & Partners Law Firm has successfully represented a private client and secured the payment of fair compensation in an out-of-court procedure in connection with poor-quality medical services provided by a private clinic.
In 2023, a woman underwent treatment at a private clinic. During the treatment, she was recommended for surgery, which she underwent. As it turned out later, the surgery was performed by doctors without necessary medical examinations, study and diagnosis. As a result of a gross violation of treatment standards by private medical institution personnel, doctors groundlessly removed one of the patient’s organs during the operation. This led to a significant deterioration in her physical and mental state.
To protect her rights, the patient sought legal advice from Ilyashev & Partners Law Firm in obtaining compensation for poor quality treatment and non-pecuniary damage.
For the protection of the client’s interests, Ilyashev & Partners’ attorney built a strategy for pre-trial settlement of the dispute and initiated negotiations with the clinic management, which allowed us to resolve the conflict within the shortest time possible and in the best interests of the client.
Ilyashev & Partners collected irrefutable evidence that the situation significantly affected the patient’s moral and psychological state. In addition, the hospital staff violated treatment standards. After evidence was collected, the management of the private medical institution offered to settle the dispute at the pre-trial stage without involving law enforcement and regulatory authorities, as well as forensic experts.
The negotiations lasted four months, from June to October 2024, and resulted in an amicable agreement. The private clinic admitted guilt, and the patient received proper and fair monetary compensation. This covered treatment, rehabilitation, medicines, psychotherapy and legal aid costs.
Alla Tsymanovska, Ilyashev & Partners’ Attorney at Law, handled the case.
“Due to the client’s timely request for legal advice, we promptly collected the relevant evidence. This confirmed the connection between the damage caused and the actions of the medical institution’s personnel. We avoided time-consuming litigation and forensic examinations. The case was resolved quickly and efficiently in the client’s best interests and in time- and cost-effective manner,” Alla Tsymanovska said.
