Ilyashev & Partners Protects Ukrainian Manufacturers of Food Packaging from Anti-Dumping Duties

Ilyashev & Partners’ International Trade team initiated amendments to the current anti-dumping measures imposed by the Interdepartmental Commission on International Trade (IСIT) on imports into Ukraine of coated carbon steel products originating in the People’s Republic of China and Malaysia.

Following the introduction of anti-dumping measures due to unfair imports from China and Malaysia on iron and steel imports by IСIT decisions (No. AD-546/2023/441-01 dated 13.07.2023 regarding China, and No. AD-590/2026/441-01 dated 26.01.2026 regarding Malaysia), specific imported raw materials not produced in Ukraine fell under restrictions, namely tinplate, which is a critically important raw material for Ukrainian manufacturers of food packaging and lids. Ukrainian manufacturers of lids and containers sought assistance from Ilyashev & Partners Law Firm.

Based on the results of the review of the application, the Interdepartmental Commission on International Trade, by its Decision No. AD-604/2026/441-01 dated 22 May 2026, decided to change the description of the goods to which anti-dumping measures apply in previous decisions and to state it in the following wording: flat-rolled products of carbon steel, clad, plated or coated, classified under subheadings, classified under the Ukrainian Classification of Goods for Foreign Economic Activity (UCGFEA) codes 7210 70, 7210 90, and 7212 40 (except for flat-rolled products of carbon steel coated with tin (tinplate or tinned tinplate) with a thickness of 0.14 – 0.28 mm (including the thickness of the tin coating layer), with a lithographed image and/or protective lacquer coating applied, used for the production of metal (tin) food containers and packaging and supplied in the form of sheets with a maximum size of 1,000 by 1,000 mm, classified under UCGFEA code 7210 70 10 00).

The decision comes into force on the date of its publication in the Uryadovy Courier newspaper.

The original anti-dumping measures on imports into Ukraine of coated flat-rolled products of carbon steel from the PRC have been in effect in Ukraine since 2023. In 2026, ICIT extended these measures to Malaysia, as the anti-dumping investigation based on complaints from domestic manufacturers revealed a large-scale scheme to circumvent duties by changing the country of origin of goods from China to Malaysia.
