Sergey Nedelko, Attorney at Law and Head of Odesa Office of Ilyashev & Partners, delivered a report, entitled “Guarantees of P&I clubs” at the Open joint meeting of the Logistics Committee and the Transportation Work Group of the European Business Association Southern Ukrainian Office within the framework of Grain & Maritime Days in Odessa-2021 International Conference, which took place on 26-28 May 2021 in Odesa.
Over the course of discussion, called “Infrastructure reforms 2021: challenges and expectations” Sergey Nedelko drew the audience’s attention to the role played, particulars of application and prospects of legislative implementation of the guarantees of P&I clubs (letters of indemnity). He also shared the success case of applying the Club’s guaranty in the practice of Ilyashev & Partners Law Firm.
“In July 2020, the State Environmental Inspectorate of Ukraine accepted the Club’s guarantee for the first time ever as a sole, appropriate and sufficient cover of a maritime claim to the shipowner due to water area pollution. I mean the sunflower oil spill accident, which involved the m/v NEW CHALLENGE at Mykolaiv Sea Port and where the interests of Club and Shipowners were successfully represented by Ilyashev & Partners Law Firm. The accident involving the m/v STAVENGER in Pivdennyi Sea Port, whereby the ship could be released against Club’s guarantee only as a matter of litigation procedure became another showcase in the practice of other colleagues,” told Sergey Nedelko.
Attendees discussed the issues of infrastructure and river reforms, the prospects of multimodal transportations development in Ukraine and changes pertinent to the customs clearance of the goods. Representatives of the Ministry of Infrastructure of Ukraine, Ukrainian Railways, local transportation and logistics business and law firms contributed to the discussion.
