Denys Nienov, the Attorney at Law of Criminal Law practice at Ilyashev & Partners Law Firm, delivered a speech on Corruption Whistleblowers: How Does This Institution Work? at the II International Criminal Law Forum held on 29 July 2020 in Kyiv by the Yurydychna Praktyka Publishing House.
In his report Denys Nienov spoke of the whistleblowing institution as such, its status, protection guarantees, terms and conditions for remuneration for reporting the facts of corruption, as well as controversial issues of legislative changes.
“We observe a low administrative liability for the disclosure of the whistleblower’s data, – the speaker emphasized. – Therefore, it is necessary to increase the amount of fine for such offense, so that it is proportionate to the subject or losses from the corruption reported by the whistleblower”.
Denys Nienov drew special attention to the risks of using legislative innovations to restrict the rights of owners when their property is being seized by a court to ensure the whistleblower’s right to remuneration.
The Forum participants discussed the expectations and results of the anti-corruption reform, the work of the High Anti-Corruption Court, the Specialized Anti-Corruption Prosecutor’s Office and the National Agency for the Prevention of Corruption.
