Ilyashev and Partners Law Firm for the second time became a partner of the International Legal Forum “Ukraine – EU” organized by the Yurydychna Praktyka Publishing House on September 24, 2015.
Olena Omelchenko, lawyer at Ilyashev & Partners Law Firm, made a report on the topic: “Protection of commercial interests: mechanisms and instruments”, in particular: global protective measures, bilateral special measures concerning motor vehicles, and anti-dumping and countervailing measures. Olena noted that the effective anti-dumping law does not need substantial revision, while the legislation of Ukraine on subsidizing and countervailing investigations needs revision, because it does not comply with the WTO rules. She also added that Ukraine has no experience in applying countervailing measures.
The event also focused on discussion of the annual results of Ukraine’s ratification of the Association Agreement between Ukraine and the European Union, the necessary infrastructure for the free trade area between Ukraine and the EU, the effective implementation of the provisions of the Agreement in the agribusiness sector, the business prospects in the light of European integration (conclusion of the Ukrainian business in the EU, and the latest trends in the withdrawal of the European business in Ukraine). The final session of the forum was devoted to settlement of disputes.
The speakers of the Forum were: representatives of the Ministry of Agrarian Policy and Food of Ukraine, the Ministry of Economic Development and Trade, the Ministry of Foreign Affairs, the AMCU, the State Fiscal Service, the judiciary in Ukraine, partners of the leading law firms, top managers and legal advisers of enterprises, members of the Ukrainian and international business associations.
