Leonid Gilevich Delivers a Speech at the III International Compliance Forum

Leonid Gilevich, a lawyer at Ilyashev and Partners Law Firm, delivered a speech entitled “How to oblige employees to follow the employers’ compliance rules” at the III International Compliance Forum which was held on 19 September 2018 in Kyiv.

In his speech Leonid Gilevich commented on the most common requirements towards employees, the limits of the employers’ control in the specific situations and the prospects of meeting the established requirements. He separately dwelt upon the nuances of applying sanctions and taking incentive measures, and also talked about the algorithms of bringing the employees to the responsibility, taking the requirements of labor legislation into consideration.

Compliance issues represent a “gray “area” in the Ukrainian labor law – Leonid Gilevich stated. – The Ukrainian Labor Code does not contain the definition of “compliance” however it actually incorporates the provisions regulating the proper behavior of employees, including in the context of compliance-related policies”.

Leonid Gilevich noted that the compliance-related rules may be incorporated into various documents which are binding on the employees: employers’ constituent documents, collective agreements, employment agreements (contracts), internal labor regulations, corporate ethics code and compliance policies, as well as other employers’ documents.
