Ilyashev & Partners’ International Trade team, under the supervision of Partner Olena Omelchenko, has achieved a significant milestone in protecting the interests of the Ukrainian manufacturer of seamless stainless steel pipes. The Interdepartmental Commission on International Trade (ICIT) issued a decision to terminate the voluntary price undertaking of the Chinese manufacturer Zhejiang Longda Stainless Steel Co., Ltd. and extend the definitive anti-dumping measures on imports of the relevant products from China for another five years.
For the first time in Ukrainian trade defense practice, an anti-dumping sunset review was combined with a review of a foreign manufacturer’s voluntary price undertaking. This resulted not only in maintaining anti-dumping protection for the domestic industry, but also in terminating the special import regime for the products of a specific Chinese exporter.
Ilyashev & Partners Law Firm represents the interests of one of the world’s leading manufacturers of seamless stainless steel pipes and a member of the international Centravis group – PrJSC Centravis Production Ukraine.
For several years, the Ukrainian manufacturer raised the issue of terminating the Chinese company’s price undertaking, yet it remained in force. Under the terms of the undertaking, the Chinese manufacturer’s products could be imported into Ukraine duty-free, provided that the established price limits were observed.
In 2025, Ilyashev & Partners’ team developed a comprehensive legal strategy that envisaged a simultaneous sunset review of anti-dumping measures and a review of the Chinese manufacturer’s voluntary price undertaking.
As part of the reviews, the law firm’s lawyers prepared legal and economic arguments justifying the necessity of maintaining the anti-dumping measures, proved the risk of continuation or recurrence of dumped imports and injury to the domestic industry, and demonstrated the insufficiency of the existing price undertaking to ensure proper protection of the Ukrainian market.
Based on the outcomes of the reviews, the ICIT adopted a decision dated November 5, 2026, which:
- extended the definitive anti-dumping measures on imports of seamless stainless steel pipes originating in the PRC for five years, maintaining the duty rate at 41.07;
- terminated the voluntary price undertaking of the Chinese manufacturer Zhejiang Longda Stainless Steel Co., Ltd. and imposed the definitive anti-dumping duty of 41.07% on its products.
Thus, for the first time since the anti-dumping measures were introduced, imports of the specified Chinese manufacturer’s products will also be subject to the definitive anti-dumping duty, ensuring a more consistent application of trade defense instruments.
“The landmark element of this case is that, for the first time in Ukrainian practice, we managed to combine an anti-dumping sunset review with the revocation of a Chinese manufacturer’s voluntary price undertaking. We not only secured the extension of anti-dumping protection for the Ukrainian manufacturer for another five years, but also resolved an issue that had remained open for a long time. This outcome demonstrates how vital it is to utilize all statutory instruments to ensure the actual effectiveness of anti-dumping measures, especially in wartime conditions when preserving domestic industrial manufacturing is of strategic importance,” noted Olena Omelchenko.
The anti-dumping measures apply to the categories of seamless pipes, tubes, and hollow profiles of stainless steel originating in the PRC specified in the ICIT decision, classified under UCGFEA codes 7304 41 00 90, 7304 49 93 00, and 7304 49 95 00.
The project team includes Olena Omelchenko and Karine Altunian, Lawyer at Ilyashev & Partners Law Firm.
