Ilyashev & Partners Secures Recovery of Over UAH 8 Million Illegally Seized During Search for Client

Ilyashev & Partners’ Criminal Law team successfully represented a client in court and secured the recovery of funds totalling over UAH 8 million, which had been illegally seized during a search in criminal proceedings.

Ilyashev & Partners Law Firm represents the client in criminal proceedings investigated by the Main Administration of the Security Service of Ukraine in Kyiv and Kyiv Region under the procedural guidance of the Prosecutor General’s Office and related to the supply of spare parts for JSC Ukrzaliznytsia (Ukrainian Railways). During a search conducted as part of criminal proceedings, law enforcement officers unjustifiably seized funds that were in no way related to the case, despite its economic nature.

With the coordinated efforts of Ilyashev & Partners’ team and a clearly defined defense strategy, the Criminal Law team managed to convince the investigating judges at least three times that seizure of the funds was unfounded and that they should be returned to their owner.

The Shevchenkivskyi District Court of Kyiv City rejected two motions by the prosecutor to impose an arrest on the funds seized during the search and separately ruled that the investigator must return the seized funds to their owner in full.

This judgment is an important example of protecting property rights and preventing arbitrary restrictions on them. The court confirmed that interference with private property rights is only possible if there are clear and legitimate grounds, which were not present in this case.
