Ilyashev & Partners Releases Client in Court on Reasonable Bail Instead of Remand

The Criminal Law team at Ilyashev & Partners successfully obtained a judgment from the Shevchenkivskyi District Court of Kyiv City in favor of a client suspected of committing a criminal offence of improper influence. The relevant judgment was issued on 11 April 2025.

As a measure of restraint, investigators from the Kyiv-based Shevchenkivskyi Police Department of the Main Directorate of the National Police requested remand in custody and set a deliberately excessive bail of UAH 1 million for Ilyashev & Partners’ client.

Ilyashev & Partners’ attorneys managed to prove not only that the prosecutor had groundlessly initiated the imposition of the most severe measure of restraint, but that the prosecutor had also unjustifiably assessed the client’s family’s financial situation and assets, which allowed for a reasonable bail amount that was not related to remand in custody. Furthermore, the client does not have a criminal record, has a permanent residence, and stable social ties, which eliminates the risk of fleeing justice or interfering with witnesses.

In response to the arguments of Ilyashev & Partners, the Shevchenkivskyi District Court of Kyiv City accepted the defence team’s legal position and dismissed the investigative agency’s application. Ilyashev & Partners’ client was released from custody in court and was ordered to post bail of UAH 151,400 (one hundred fifty-one thousand four hundred) within five days.
