Ilyashev & Partners Secures Bail Reduction Exceeding UAH 20 million in Defense Procurement Cases

Ilyashev & Partners’ Criminal Law team has succeeded in reducing the bail for clients in two high-profile cases related to defense procurement, which were heard by the High Anti-Corruption Court (HACC).

Both cases concern the supply of products to the Armed Forces of Ukraine during the first months of Russia’s full-scale invasion of Ukraine.

The first proceeding concerned the purchase of aircraft tyres by the Logistics Forces of the Armed Forces of Ukraine. According to the investigation, the procurement procedure was violated, resulting in an overpricing of the products. Officials from the National Anti-Corruption Bureau of Ukraine and the Specialized Anti-Corruption Prosecutor’s Office requested the court to set bail at over UAH 25 million for the director of a private company.

With the coordinated efforts of Ilyashev & Partners’ team and a clearly defined defense strategy, attorneys managed to convince the investigating judge that the proposed bail amount was unreasonable, which was subsequently reduced by UAH 16 million.

In the second case, the investigation claimed that military goods were not supplied in full to the Armed Forces of Ukraine. The HACC considered the motions to impose remand in custody as a measure of restraint without bail on the former director of a state enterprise filed by the Security Service of Ukraine and the Specialized Military Prosecutor’s Office within the Prosecutor General’s Office. However, the prosecution subsequently changed its position and requested the court to set bail at UAH 5 million.

Given that the case had already been heard by the Commercial Court of Kyiv City, which ruled in favour of the state enterprise, the HACC accepted the grounded legal position of Ilyashev & Partners’ attorneys and partially satisfied motions filed by the law enforcement agencies, reducing the bail amount sixfold.
