Ilyashev & Partners Law Firm successfully defended the interests of one of the largest grain elevators in southern Ukraine in a complex commercial dispute with a Ukrainian exporter and a foreign grain traderregarding the reissuing of grain rights.
The elevator, located on the territory of the Kherson Sea Port, provides storage, processing, and transshipment services for grain cargoes and serves as a key logistics hub in the region. In 2021, the elevator made an agreement with a Ukrainian exporter to provide storage services for about 2,000 tons of grain worth more than USD 2 mln.
The dispute over the grain was considered by courts in several stages. The owner of the grain (the Ukrainian exporter) sold it to a foreign grain trader but failed to fulfill its obligations under the contract. In 2023, the foreign grain trader filed a claim directly against the elevator. However, due to the work of the Ilyashev & Partners team, the court agreed that the elevator was not a liable party and acted strictly within the scope of its contractual obligations.
In 2024, the Ukrainian exporter filed a separate claim with the Commercial Court of Kyiv City, seeking to oblige the elevator to re-register the rights to the grain in favour of another Ukrainian company. At the same time, within the framework of the same proceedings, the foreign company filed a claim against the Ukrainian exporter, demanding actions aimed at re-registering the grain.
The interests of the elevator in court were represented by Ilyashev & Partners Law Firm. The firm’s team thoroughly analysed the contractual obligations and confirmed that the exporter had violated the established procedure for re-registration of rights to the goods, clearly demonstrating that the elevator had acted properly and in good faith, while there were no legal grounds for re-registering the rights to the grain in favour of the Ukrainian company.
As a result of the efforts and well-supported position of Ilyashev & Partners’ lawyers, the court upheld the elevator’s position and dismissed the Ukrainian exporter’s claim.
