Ilyashev & Partners Law Firm successfully represented a Ukrainian military technology company, a producer of tactical laser simulation systems for military training, in a case concerning the violation of procurement procedures by the customer during a tender initiated by a higher state education military institution responsible for officers’ training.
In 2025, the higher education military institution conducted an open tender on the Prozorro platform for the procurement of specialized equipment, namely tactical simulators for training based on laser technologies. Two companies participated in the process, one of which – a client of Ilyashev & Partners Law Firm – provided a complete and satisfactory set of documents in accordance with the tender documentation requirements.
Despite this, the procuring entity rejected the proposal of Ilyashev & Partners’ client, citing the alleged lack of information on the technical and quality characteristics of the procurement item in the tender proposal.
To protect its rights, the Ukrainian producer of tactical military simulators sought legal advice from Ilyashev & Partners Law Firm. The Antitrust and Competition team prepared a complaint to the Antimonopoly Committee of Ukraine (AMCU), substantiating the unlawful nature of the procuring entity’s actions. In particular, the attorneys demonstrated that:
- the Ukrainian producer had provided all the necessary documents confirming the compliance of the proposed goods with the technical, quality and quantity requirements of the procuring entity;
- the reason for the rejection of the proposal by the procuring entity concerned minor technical issues (in particular, a technical error in one digit in the number of the certificate of compliance with technical specifications), which did not affect the content and completeness of the tender proposal;
- the Ukrainian producer additionally provided a specification of the constituent elements of the procurement item, which in no way changes its essence, but rather confirms the completeness and transparency of the complete set, while the procuring entity did not prove or provide documentary evidence of how this affects the content of the proposal.
The AMCU Commission accepted the legal arguments of Ilyashev & Partners’ attorneys and ordered the procuring entity to cancel its decision rejecting Ukrainian producer’s proposal.
