Ilyashev & Partners Initiates Review of Definitive Anti-Dumping Measures on Imports of Steel Fasteners from the People’s Republic of China

Ilyashev & Partners’ International Trade team under the supervision of Partner Olena Omelchenko initiated the reconsideration by the Interdepartmental Commission on International Trade (ICIT) of definitive anti-dumping measures on imports to Ukraine of steel fasteners originating in the People’s Republic of China.

Ilyashev & Partners Law Firm represents the interests of the largest and only specialized manufacturer of fasteners in Ukraine – PrJSC Druzhkovka Hardware Plant.

The firm’s team initiated the review by the ICIT on behalf of Ukrainian producer to support fair competition in the Ukrainian market, given the expiration of the current anti-dumping measures on September 28, 2025.

Ilyashev & Partners’ International Trade team has collected and submitted sufficient evidence to the Commission to initiate the reconsideration of anti-dumping measures against Chinese manufacturers. Based on the results of considering the complaint of the national producer, the ICIT adopted a decision to review the definitive anti-dumping measures, which will take effect from September 27, 2025.

Thus, the anti-dumping measures imposed by the ICIT’s decision dated September 29, 2020, No. AD-437/2020/4411-03, regarding imports of steel fasteners originating in the People’s Republic of China into Ukraine, have been extended until the Commission adopts a new decision based on the results of the review.

In 2020, Ilyashev & Partners International Trade team defended the interests of PrJSC Druzhkovka Hardware Plant and in a record period – 9 months – secured the application of definitive anti-dumping duty on imports of steel fasteners from the People’s Republic of China. Definitive duties in the range between 32.47% and 67.4% were introduced on September 29, 2020, for five years, on carbon steel threaded products such as screws, bolts, and nuts, classified under UCGFEA codes 7318 15 68 90, 7318 15 82 90, 7318 15 88 90, 7318 15 95 90, 7318 16 92 90, and 7318 16 99 90.

In 2025, Ilyashev & Partners International Trade team initiated an investigation into the circumvention of anti-dumping duties on imports of steel fasteners originating in the People’s Republic of China through the supply of similar products from Malaysia.

To prevent further circumvention, the Commission requires Malaysian exporters to pay advance duties (including VAT) at 67.4%, equal to the highest rate imposed on Chinese producers. This temporary mechanism will remain in effect until the investigation is complete.
