Ilyashev & Partners Law Firm, which represents interests of the Ukrainian Red Cross Society, secured holding the trade mark of one of the largest pharmacy networks invalid.
On 12 April 2021, the Commercial Court of Kyiv City held invalid the trade mark under the certificate No. 38130, which features the image of a red cross. More than 400 pharmacies of the network in question that are located in 100 Ukrainian cities have been using this trade mark on their signboards, in advertisements and on several web-sites on the Internet.
The project was elaborated by Attorney at Law Dmytro Nikulesko and Lawyer Olena Sereda. Legal services were provided by the firm to the Ukrainian Red Cross Society pro bono.
May we remind that previously Ilyashev & Partners Law Firm put an end to the illegal use of the Red Cross Emblem by one of Ukraine’s large medical center networks.
The Ukrainian Red Cross Society has a special humanitarian mandate, humanitarian initiative as a member of the International Red Cross and Red Crescent Movement, and operates under tthe Law of Ukraine “On the Ukrainian Red Cross Society” and the Law of Ukraine “On the Red Cross, Red Crescent, and Red Crystal Symbols in Ukraine”. Pursuant to the national legislation of Ukraine and international treaties, the use of the Red Cross Emblem is allowed only to the Red Cross Society and its representative offices in Ukraine.
