On 10 September 2021, Denys Nienov, Attorney at Law at Ilyashev & Partners Law Firm, delivered a speech on Undue Influence: The Supreme Court Practice at the VI International Business Protection Forum in Kyiv, organized by Yurydychna Praktyka Publishing House.
Denys Nienov analyzed the most challenging issues of the undue influence classification arising at the Supreme Court level.
“Failure to rule on the covert investigative and search activities, and collection of evidence by the unauthorized body of pre-trial investigation are the main grounds for acquitting judgements under Article 369-2 of the Criminal Code of Ukraine: undue influence”, – explained Denys Nienov.
The session participants discussed the criminal and legal risks of business: problems arising in the course of applying a measure of restraint to a suspect, seizure of the enterprise’s property, ensuring the information security for a law firm in Ukrainian realities, building the business protection system, and also shared the real-life cases.
