The Commercial Court of Kyiv Region ruled in favor of a national manufacturer and distributor of food products, ordering the Russian Federation to pay over USD 6.8 million in damages for losses caused by the armed aggression of the Russian Federation and the temporary occupation of part of the territory of Ukraine.
One of the largest tea and coffee manufacturers in Ukraine lost its production facility due to the armed aggression of the Russian Federation, as the facility was destroyed during active hostilities and a hostile missile attack on the Kyiv Region in 2022. As a result of the loss of all production capacities, assets, raw materials, and finished products, the Ukrainian manufacturer has been unable to produce part of its products since 2022 and was temporarily forced to suspend full-scale operations.
In order to protect the client’s interests, Ilyashev & Partners’ lawyers filed a claim with the Commercial Court of Kyiv Region seeking compensation from the Russian Federation for the damages caused to the enterprise by military aggression.
Ilyashev & Partners’ lawyers proved in court that, as a result of the destruction of the Ukrainian manufacturer’s production and property complex, the company was deprived of the opportunity to manufacture products for further sale and profit generation. Accordingly, there were legal grounds to recover from the aggressor not only actual damages, but also a loss of profit.
The Commercial Court of Kyiv Region accepted the well-founded legal position of Ilyashev & Partners’ team and satisfied the claim initiated by the Ukrainian company, ordering Russia to recover over USD 6.8 million in damages.
