Today the Kyiv Administrative Court of Appeal dismissed the petition of the Prosecutor General’s Office and the Ministry of Industrial Policy and upheld the ruling of the Kyiv District Administrative Court of 4 September 2014, according to which Dmytro Kiva was recognized as the sole legitimate head of the state strategic enterprise Antonov. It is reported by the press service of Ilyashev & Partners Law Firm representing SE Antonov.
“According to the Code of Administrative Procedure of Ukraine, after the court of appeal approves its decision, the ruling becomes final and its further appeal is not allowed. Accordingly, at present the matter with the head of SE Antonov has been resolved completely”, emphasized at Ilyashev and Partners.
It is to be recalled that in May and July 2014 the Ministry of Industrial Policy ordered to dismiss Dmytro Kiva from office of the President of SE Antonov, and to appoint S. Merenkov as the acting President. As early as on 23 March 2014, the Government decided to liquidate the Ministry of Industrial Policy by its joining to the Ministry of Economic Development and Trade of Ukraine. On 1 August and 3 September this year, the team of SE Antonov did not allow S. Merenkov with his accompanying thugs (“titushky”) for hire to the industrial premises. On 3 and 4 September, the Kyiv District Administrative Court passed rulings confirming the powers of D.S. Kiva as the President of SE Antonov. On 12 September, the Kyiv District Administrative Court invalidated the order of the Ministry of Industrial Policy appointing S. Merenkov as the acting President of SE Antonov.
