Roman Marchenko, Senior Partner at Ilyashev & Partners Law Firm, Delivered a Report at the EBRD Workshop “Insolvency Office Holders – Navigating Stakeholders Through Insolvency”

On November 07, 2014 headquarters of the European Bank for Reconstruction and Development (EBRD) in London hosted a workshop “Insolvency Office Holders – Navigating Stakeholders Through Insolvency”.

загруженоThe conference was devoted to comparative assessment into the insolvency office holder profession in 27 of the jurisdictions where the EBRD invests, including Ukraine. The assessment was carried out in 2013-2014.

Participants of the workshop discussed the most effective model for regulation of IOH activities, incentivizing the best candidates to become insolvency office holders, determining IOH fees, effective measures related to recovering assets from the debtor’s estate, role of the courts in managing insolvency cases and autonomous nature of work performed by IOHs in practice.

Roman Marchenko, Senior Partner at Ilyashev & Partners Law Firm delivered a report on the local Ukrainian particularities of IOH profession. Roman Marchenko, a licensed insolvency office holder since 1999, provided a comprehensive description of the IOH profession in Ukraine, and focused his report on amendments introduced into the new version of the Law of Ukraine on Restoring Debtor’s Solvency or Declaring a Debtor Bankrupt.

The co-speakers were Heads of the EBRD Legal Department, representatives of the International Monetary Fund and the World Bank, the judge of the Hungarian Supreme Court of Justice, partners at Ernst & Young and Allen & Overy LLP.
