Roskomnadzor Closed Websites Publishing Sponsored Articles about Kazakh Billionaire Under Landmark Court Ruling


Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications (Roskomnadzor) completely fulfilled the Ruling delivered by Tushynskiy District Court of Moscow dated May 15, 2017 on a claim brought by Kazakh businessman Kenes Rakishev and included three website references into the Unified Register of Websites Containing the Information Forbidden for Dissemination. Communication services providers consequently limited the access to the websites that publish fake data about the businessman.

This is the first time in Russian case law when the access to websies was blocked as an injunctive relief regarding the claim of the individual in the case on personal and business defamation and declaring the activities of Internet sources illegal. The claim was satisfied to prevent further dissemination of false information.

“The court perfectly resolved the situation referring to the judgments of the Constitutional Court of the Russian Federation and the European Court of Human Rights including Article 2 of the International Covenant on Civil and Political Rights, which obliges the state to ensure an effective remedy to any person whose rights or freedoms are violated”, commented Vladimir Zakharov, Head of Moscow Office at Ilyashev & Partners Law Firm.

The websites with the limited access are owned by the legal entities established in the USA.
