Antonov Was Awarded UAH 25 Mln Damages by Court from Ankara Airport for Aircraft Incident

Antonov, State Strategic Enterprise, received UAH 25 mln based on the results of litigation with the General Directorate of State Airports Authority of Turkey and its underwriters. The respondent additionally covered all fees for services provided by lawyers and experts involved into the case by the State Enterprise.

Consequently, the damages, caused by Ankara Airport’s violation of the international standards for aerodrome bird/wildlife control and Antonov’s expenses for legal protection, were fully indemnified. It is worth to mention that in March of 2008 Antonov An-124-100 Ruslan cargo aircraft collided with birds on its take-off at Ankara Airport. Therefore, the aircraft was damaged, the crew and the cargo were not affected. In 2009 Antonov filed a claim to the Turkish court on damage recovery.

“The court ruled that the Turkish party in breach of legislation and ICAO standards did not take all necessary measures for aerodrome bird/wildlife control that caused the incident. The respondent’s force-majeure claims were also denied by the court”, Roman Marchenko, Senior Partner at Ilyashev & Partners Law Firm, commented on the case.

The judgment of Ankara court obtained in favor of Antonov back in 2012 has been repeatedly challenged by the Turkish party. Following the results of long-term litigation, in May of 2017 Antonov received the complete pecuniary compensation to its bank account.
