Roman Marchenko Moderated a Conference Dedicated to Law of Procedure Reformation

Roman Marchenko, Senior Partner at Ilyashev & Partners, acted as a moderator at the session dedicated to the development of ideal formula for litigation fees at the conference “Reformation of Procedural Law: Efficient Litigation or New Challenges?” held on April 7, 2017, in Kyiv.

The speakers of the session paid the conference’ participants’ special attention to the new options that will be available due to the introduction of “electronic court”, on peculiarities of the presumption of complete coverage of all expenses related to court hearings and respective preparations.

During the discussion the experts searched for the ideal formula of litigation fees. Effective compensation for court fees is one of the fundamental basis of the reformation of procedural codes. The representatives of attorneys’ community have been expecting the corresponding changes for a long time already. “We have been waiting for a long time for the litigation to become expensive” – said Roman Marchenko. According to Mr. Marchenko, due to current low costs of litigation proceedings the legal institutes that successfully function in other countries are actually absent in Ukraine (for example, mediation).

In the course of the conference the representatives of the Ministry of Justice of Ukraine, judges, external legal counsels — partners of law firms discussed the reformation aspects of Ukrainian judicial system in accordance with the European standards; the novelties in business litigation; the necessity in the unification of definitions at legislative level, as well as the most common types of procedural abuses and modern tools for the prevention of such abuses.
