The Partner, Attorney at Law and Head of International Trade Practice Olena Omelchenko and the Attorney at Law Roman Protsyshyn delivered speeches at the Ukrainian Arbitration Forum held on 11 November 2020 in Kyiv. The event was organized by Yurydychna Praktyka Publishing House.
Olena Omelchenko moderated a session on dispute resolution within the WTO, including the bilateral dispute settlement mechanism provided for by the EU-Ukraine Association Agreement.
The session participants discussed the procedure for ensuring the protection of Ukraine’s rights and interests in the trade and economic field within the WTO, the role of legal advisers involved at the consultation stage and the Advisory Centre on WTO Law.
During the Industrial Arbitration session, Roman Protsyshyn delivered a report on Maritime Arbitration Institutes. Roman spoke about litigation specifics of the maritime arbitration institutions, as well as the peculiarities of maritime disputes consideration within a framework of ad hoc arbitration under the LMAA Terms.
“Last year, the dynamics of the arbitrators’ appointments under the LMAA Terms was studied, and their number exceeded 3 000. Such statistics do not reflect the situation as a whole. Most maritime disputes worldwide are resolved in ad hoc arbitration under the LMAA Terms. For comparison, in 2017 there were about 9 cases considered by the ICAC at the Ukrainian CCI, and only 5 cases in 2018”, — noted Roman Protsyshyn.
The participants discussed international contracts in the energy sector, banking disputes and arbitrations within a framework of agro-industrial disputes.
