Oleksandr Fefelov Moderated the Panel Discussion Devoted to the State Procurement at III Ukrainian Antitrust Forum

Oleksandr Fefelov, Head of Antitrust and Competition Practice at Ilyashev & Partners Law Firm, moderated the panel discussion devoted to the public/state procurement at the III Ukrainian Antitrust Forum which took place on May 31, 2017 in Kyiv.

In the course of the discussion the experts discussed the particularities of application of the Law of Ukraine On Public Procurement towards the non-residents, the possibilities of using the foreign currencies for making settlements, as well as the abuse of discretion provided by the Law for establishment of the requirements limiting the competition. In particular, the speakers highlighted the problems arising in the process of procurement of legal and notarial services.

“The Law of Ukraine On Public Procurement has been in full force and effect in Ukraine for almost a year. Throughout this period the society, as well as the specialists in the sphere of public procurement, have managed to fully realize the scale of positive amendments introduced into the procurement system, – Oleksandr Fefelov says. – It is impossible to work out the public procurement system for such short period of time. Lawyers and specialists in the public procurement sphere are meant to assist the tuning up of the public procurement system and of the procedure for appealing the results of the tenders, as well as to actively cooperate with the administrator of Prozorro (e-procurement system) – the Ministry of Economic Development and Trade of Ukraine – in the process of implementation of the state policies in the public procurement sphere, as well as with the appeal body – the Antimonopoly Committee of Ukraine, by rendering, in particular, methodological assistance to the buyers and potential participants of the tenders – suppliers of products and services related to the public procurement procedures“.

During the forum the participants drew attention to the high professional qualification of the Antimonopoly Committee of Ukraine displayed in the process of consideration of complaints in the tenders’ domain.
