Mikhail Ilyashev, Managing Partner of Ilyashev & Partners, participated in the roundtable “Maundy Thursday before Friday the 13th” New rules of providing information about medicines, which took place on July 12, 2012 in the conference hall of PARUS Business Centre (Kyiv). The event was organized by Publishing House “Morion”, Publishing House “Zaslavskyi”, Publishing House “Zdorovia Ukrainy”.
The roundtable was devoted to the legislative amendments in the advertising of medicines, which became effective on July 13, 2012. In his speech, Mikhail Ilyashev noted that discussion of the concepts “information” and “advertising” that broke out after adoption of the Law of Ukraine No. 4196-VI was due to the vagueness of its provisions allowing their ambiguous interpretation.
Mikhail Ilyashev emphasized that with regard to medicines the concepts “information” and “advertising” are not equivalent. Thus, according to Art. 26 of the Law of Ukraine “On Medicines”, information support in the field of creation, production, quality control and sale of medicines in Ukraine includes both of these concepts, but with regard to advertising of medicines the effective provision is referential (according to Art. 21 of the Law “On Advertising”).
The event was of great interest to the professional community, it was attended by more than 300 people. Other experts present were Semen Gluzman, member of the Public Council at the Presidential Administration of Ukraine, Volodymyr Ignatov, Executive Director of AIPM Ukraine, Andriy Stogniy, Head of EBA Health Care Committee, Yuriy Savko, Chairman of APRaD, and many others. During the event the participants had the opportunity to listen to expert opinions, ask questions and express their views on issues raised.
